Though this is a civil-rights issue from our perspective, in the courts it has been framed as a property issue.
Hate me for saying this, but I really don't think this is a civil rights issue. It's just a representation of people who are using the obscurity and elasticity of the law for personal gain- whether it be higher property value or some absurd xenophobic ideal.
I just don't see how you can declare a written subdivision covenant or a successful appeal to re-interpret a statute of limitations a violation of civil rights... it happens all the time to all kinds of people. Whether or not the intent has racist roots is irrelevant as long as the petitioners play by the rules. Legally, this is in fact only a property issue.
That being said, I hope to see the representation of the Gurdwara win this one! Best of luck!
