car accident question

so unfortunately today i met with a car accident...

i was stopped behind two cars and we were stationary... and some guys behind me isnt paying attention and hits the brakes too late and rear ends me....him rear ending me caused the guy behind him to stop short and get rear ended by another car, who was then rear ended by another car. in total it was a 6 car accident...

now as far as my car goes the damage is not too bad... but from what i understand and what everyone has told me, my situation im not at fault. the driver who hit me is at complete fault..

now here's the situation... its a hit and run... that asshole drove away as i was walking to his car.. couldnt get his license plate or anything.. now obviously sense it was such a big accident the cops showed up with ambulances and what not..filed a report as a hit and run and was done with it..

now i had a few questions if anyone has any idea as to how insurance policy works in new york..

my car is a lease, ive got full coverage and gap coverage so im not worried about claiming, but since im at no fault will my insurance premiums go up?

the next question is the one im worried about... my back and neck hurts after the whiplash of getting rear ended and my friend who was in the front passenger seat is in the same situation. i plan on going to the hospital tomorrow morning. now for me im not worried as far as geting my insurance to cover my injuries and bills but what about my friend? is he in a situation where he's going to sue me? how exactly does that work. i was talking to him after the accident and he told me he plans on going to the hospital tomorrow morning and he's also getting a lawyer so im a little afraid as to whats going to happen. im not tryna get hit with like a 100,000 dollar lawsuit or anything over something that wasnt my fault..

after doing my research on google i learned that the passenger and driver both would sue the driver that hit us but in our situation he does not exist. nigga ran away... so im lost as to what to do

idk if any of you work in insurance or anything but if you guys have any sort of advice or answers id greatly appreciate it.

hey sorry to hear about your accident dude. Hope it all works out for you. Just wanted to ask you though, maybe I misunderstood you, what kind of friend do you have, that he would even think about suing you for something that wasn't even your fault?

There is no way your friend is in a situation to sue you. If its established that the collision isn't your fault (and a hit and run really helps your case) then how could your friend sue you? on what grounds would he do so? I'm no expert, but im pretty sure he cant do anything of that sort against you, even if he wanted. The lawyer he's getting is most likely for his claim against the insurance company for his injuries.
I'm sorry to hear about the accident, hope you recover from your injuries soon.

well he's a good friend of mine... but normally in such a situation you would be suing the insurance company of the driver at fault..in this situation the driver at fault is no longer here... and he's goign to the hospital because of pain... so in this situation idk what he's supposed to do but i would think that he would sue my insurance company... my question was would that possibly have any personal liability on me

insurance covers but we got third party insurance and when you try to get claim you have to pay like 500- some amount for dedeductible. so its loosing more money and insurance going up too

There is no way your friend can sue you or your insurance company. He rode in your car with his own discretion. You did not inflict pain on him, it was a third party (the hit and run suspect). Unless the suspect is found, your friend has nobody to sue. Its as simple as that. His hospital visits will be covered by his own insurance. Its sad but true.

I was hit and run on the freeway going home at 12am on the night of DDA (2006). The freeway was basically gridlocked. Why there was that much traffic at that hour is beyond me. Anyhow, I was rear ended by one of those really small Toyota MR2's. I was in the far right lane. The guy who hit me proceeded to swerve into the far left, and then back onto the far right shoulder of the freeway. This whole time Im pissed off and chasing the guy. He takes the next exit and drives into a hotel parking lot. I get out of my car and run to his. Turns out its a small car packed with 5 mexicans, illegal aliens. No license, no registration, no insurance. The front of the guy's car was gone, My car had a small dent on the rear bumper. The guy offered me $800 (boy was I an idiot to turn it down) to resolve. Instead, I called the CHP. In the end, I was left screwed and my only option was to get my car fixed through my own insurance (the rate would go higher) since the dude who hit me obviously didn't have any. I ended up not even getting the bumper fixed, and let the scratches accumulate over the course of about two years until someone side swiped the car. At this point I got the person's insurance and basically just got the whole car fixed haha. My point is that you can't rely TOO MUCh on your insurance. its there when you REALLY need it. But for something like this, if your car isnt really that damaged, and the suspect is nowhere to be found (you dont even have a his plates), its a lost cause dude. It really sucks, and although my situation wasnt half as bad as yours, I know how it feels eh.

Bro, ure friend has no bases in which he can sue you. You werent the one who hit somebody while he was in the car with you. You were hit, and like amanpaul said, the hit and run helps your case. The third party is at fault.

btw, doesnt NYC have traffic cameras all over the city anyways, cant you have ure insurance company somehow get that traffic footage? Or if there was a store around there and they have cameras outside that may have gotten a glimpse of the car and possibly a shot of the plates? Im jus tryin to throw ideas out there for you to somehow get some justice.

the only way he would be able to get any kind of camera footage is if this incident was taken to court and a subpoena was issued. But without a suspect, there can be no trial. Although a hit and run is a serious offense, it is not "serious enough" for authorities to look that far into it without proper testimony from witnesses and evidence. This type of incident is routine for law enforcement. Sorry to say.

sonu ur insurance will check where the damage was....
there were still other cars involved in the accident it wasnt just your 2 cars it was a cascade
the location of the damage is the rear.. any logical person can guess that you got rear ended and that is 100% not your fault
i can tell you this from my accident..someone hits the rear of your car theres nothing to worry about your good

Hey Sonu sorry about ur accident, i'm a Personal Injury Paralegal in CA... the biggest problem i c with ur situation is the passenger. technically he is allowed to sue u and go behind ur insurance. u can basically just claim u had a passenger and was hurt and the insurance should cover it if u have med pay... they will pay to ur max coverage however, if ur friend has a higher doctor's bill and is also claimin "pain and suffering" that could be more than ur coverage and he can sue u (if u have property or business)... there r loop holes to get through his... ur insurance adjuster should be able to negotiate it and u shouldnt have to pay out of ur pocket the drs usually get a 1/3 of their total bill so dont get surprised if u get like 5-6 grand bill from the dr only. if u have at least $5000 med pay coverage i think u should be fine... usually the adjuster try to adjust it within ur limit... make sure u open a claim at the earliest to avoid other conflicts and if u have a copy of the police report fax it over to the adjster at the earliest. if u dont have the report u can give them the info and they will request it.

also make sure u let the insurance know that it was a hit and run... u dont want the other drivers to go behind u claiming ur at fault cuz they can try to do that so police report will be very imp and/or witnesses... as per ur car insurance its probably gonna go higher up especially if the passenger is claiming their injuries i say change the company once ur done with this it might be lower than wut the offer u for the next coverage... hope that helps let me know if u have any questions :)
